It is and while I'm certainly not a fan of lawyers, I wish I had called one in earlier when I was register trademark. I had a number of corrections to do, which I thought I could handle on my own. Then finally I got a fatal error and when I added all the costs up, it cost me a LOT of time and eventually money as well. If you want to finish things right and fast, a lawyer is a big help, like it or not.

Also, forgot to mention. You should attach the tm symbol after your trademark while it's under registration. Once it's registered, you get to put the R after it.

I'm curious to know if there are any steps you should take afterwards as well? As in, once you've registered a trademark, is there anything in particular you should do?

Another really good question, especially because again, people keep making mistakes here that cost them later. I can understand that it will probably feel like once you register trademark, it's smooth sailing from there on out. But it's not, you need to make sure you keep doing the following things.

      • Make sure your portfolio is always updated. If the Trademark office finds any kind of discrepancy, that could constitute as fraud and you could end up getting your registration cancelled. Don't take this too lightly, they do follow things up rather stringently.

      • Make sure your records are updated as well. This is more for legal reasons, which is why you need to have things like your first use dates carefully recorded.

      • Constantly and vigilantly check to see if any trademark infringement is being done on your product. You've taken the time and effort to get it registered so it makes sense to protect it as well. Don't be lax about this AT ALL. If you 'let things slide', you're essentially giving a green light to let others do the same and your trademark will lose value. As your product becomes more valuable, it might be a good idea to set up a watchdog service to monitor things for you.

One more item I think is important for post-registration, and this can make you some bucks. Sometimes people will want to use your trademark. You HAVE to have a licensing agreement in place in order for someone to use it. Definitely call in a lawyer here to help you out and explain to you what exactly the licensing will mean for your business.
