      Importing wine into America - US rules and regulations on the import of alcohol

      I am working on a business plan to have a UK wine producer supply wine for my business. I do not know the US rules and regulations for importing alcohol.

      The wine producer has his alcohol seller's permit for the UK, but will I need to get an American business license as well?

      Please advise what is needed to import wine to the United States.

      Yes, you will need to have a business license and a permit to sell alcohol if you intend to sell the wine you import.

      The state and local requirements of selling alcohol vary. Contact the state alcohol control board in the state where your business is based.

      Here is what you need to know before importing wine into America:

      Apply for Importer's Basic Permit from TTB (Alcohol and Tobacco Tax and Trade Bureau)

      You can fill out the Basic Permit Form 5100.24 online

      Must have and staff a business located within the United States

      Obtain/Apply for Employer Identification Number from the IRS

      Complete Alcohol Dealer Registration TTB 5630.5 form

      You will apply for the TTB 5630.5 form after you are approved for the Basic Permit

      Obtain a TTB certificate of label approval (COLA) for each unique product label

      the application for and certification/exemption of label/bottle approval TTB form 5100.331 is needed for each different brand of wine imported

      Wine produced after December 31, 2004 must meet the regulations of the Miscellaneous Trade and Technical Corrections Act of 2004 to ensure the wine receives proper cellar treatment

      Pay the related taxes and duty for all imports

      In addition to the above, it is imperative that the wine producer is legit. The wine can be seized by customs (and not returned) if the wine is unsafe for the public.
      Make sure the wine producer is registered with the FDA and provides the FDA with import notification.

      Very thorough checklist above on what to do before importing wine to the USA.

      One thing to add: if you are a first time importer then you must submit a letter of intent to the foreign supplier for their records; this shows your intentions and responsibility in relation to the business.

      The UK wine producer should be able to give you an average on how much it cost to import wine into the US.

      For beer the import tax is $18 per 31 gallon or $0.05 per 12 oz. can.

      The wine import tax fluctuates by the percentage of alcohol.

      For example, a gallon of wine with 14% or less alcohol carries a $1.07 import tax, but a gallon of wine that is artificially carbonated carries a $3.36 import tax.

      OK I will check with my supplier about their FDA registration and the average cost to import wine.

      I appreciate the help with the import form and license information.
