      Is selling pre-owned video games legal?

      A friend and I were talking the other day and he told me it is going to be illegal to sell pre-owned video games from now on Ė is this true?

      Is it still legal to sell pre-owned video games or have they outlawed it?

      Forgive me if I sound like an idiot, but he sounded pretty convincing.

      Has anyone heard any rumors about used video game sales being made illegal?

      Game companies – EA especially – have been trying to make it illegal to sell pre-owned games but have been unsuccessful.

      In September 2010, a suit was overturned saying that a person did not have the legal right to sell a pre-owned computer program. While that is something to watch out for, I don’t expect selling pre-owned video games to become illegal anytime soon.

      For one, the video game industry itself relies on the pre-owned game money. Video games stores in the US are big for customers who use their old games to purchase a new one.

      The market on eBay has continued to grow for pre-owned games as well. Video gaming companies feel they should get a portion of the profits if you sell the game.

      That would be like a furniture company wanting a share of the couch you sold. Certainly keep up with the topic, but you are safe to sell used video games.

      Personally this is one area where I wouldnít care if it was illegal. How can the video game big wigs expect a cut of my profits? Maybe they should focus on making their games cheaper.

      OK. I did not want to start getting in the pre-owned video game market just to discover that the market is off limits.

      I saw that there were still a lot listed on eBay and that’s when I became skeptical about my friend telling me selling used video games was not legal.

      The rumor that pre-owned video games are illegal to sell has been going on since people started selling their old video games.

      As said above, it is an issue that has to be watched because you never know what crazy laws will be passed but you are still in the clear to sell or buy a video game that has been pre-owned.

      Video game companies just want a royalty cut. As long as games can be traded in at a store, we will be OK selling them online.

      I think the case with the computer program is different because that is a licensing issue to operate the program. They have a long licensure contract – not so with video games.

      Right now pre-owned video games are safe because the courts are not going to open the door on this issue. The same would then have to be done with DVDs, books and even vinyls.

      The pre-owned video game market can be tough.
