      Buying clearance stock from retailers to resell on ebay - Help please?

      Hi there, im a little confused as to some things and would appreciate some help

      First of all, is it ok to do this? I know retailers dont like you buying products (whether its clearance stock or not) to resell, but is there anything they can actually do once you have the item?

      I have an independant sellers account on ebay (not business) and would be reselling the items there. Does this qualify as trade? Would I need to be registered as a Sole Trader in order for this to be legal?

      Yes in your case you would be classed as a business, and would need to register as a sole trader. From what you have described, you will not be selling used goods, but brand new goods purchased for resale at a profit. Therefore in the eyes of the law you are classed as a for profit business.

      Technically speaking, there is nothing stopping you buying from retailers to resell their products elsewhere at a profit, however the retailer can refuse to sell to you if they have a policy against buying for resale and if they figure out you are buying from them for that purpose. In a nutshell, act like you are buying for yourself, and not for resale. Some giveaway signals are buying random sizes, buying multiple units of the same product, frequent visits to the store, etc.

      Also beware that if you are buying branded goods for export, it becomes a completely different legal ball game. Look up grey market goods in Google for details.
